Tom
Harris Auctions (hereinafter “Harris”) does not warrant the condition,
accuracy, genuineness, authenticity, description, weight, count or measure of
any property sold at this auction. All property shall be sold AS IS, WHERE
IS, with all faults and without any expressed or implied
guarantees or warranties of any kind. It is Buyer’s responsibility to
determine the condition, accuracy, genuineness, authenticity, description,
weight, count or measure of any property purchased at this auction. Any property
purchased at said auction may not be returned. That in the event a buyer
initiates litigation against Harris for any reason, then buyer agrees to
reimburse Harris for his reasonable attorney fees and/or costs incurred in any
such action. In the event Harris is
required to initiate litigation and/or collection actions against Buyer, then
Buyer agrees to reimburse Harris for his reasonable attorney fees and/or
collection costs incurred in any such action. All parties agree that jurisdiction and venue for any such litigation or
collection activities shall be in Marshall County, Iowa.
2.
Payment Terms: A 10% (in-house attendees only) or (15% Absentee & Telephone Bids) Buyers Premium will be added to the purchase price of all
items sold in this Auction. Cash, Travelers Checks, Cashiers checks only.
Personal Checks may be accepted if the purchaser is personally known to the
Auction Company or said Check is accompanied by a bank Letter of Credit
provided to the Auction Company prior to the day of sale. Only Visa /
MasterCard may be used, but will have an additional 3% handling and
execution fee added to the total price. In the event that Tom Harris Auctions
has to initiate action to collect funds from this or any other auction, then
buyer agrees to pay any and all collection costs and fees incurred in the
collection of such funds, including, but not limited to, Harris’ reasonable
attorneys fees and costs incurred in conjunction therewith.
3.
Absentee
or Telephone Bidding: 15% Buyers Premium on all Absentee or Telephone Bids. Said premium, purchase price
and applicable tax will be charged to your MasterCard or Visa / American Express ONLY in full on
the day of sale or with in 3 days. All Absentee or Telephone Bids must be accompanied by a
pre-signed credit card authorization and a pre-signed authorization for the
Auction Company to surrender purchased items to preferred shipper (if other than
Tom Harris Auctions). No Exceptions. The Auction Company reserves the right to
reject or cancel any and all Absentee or Telephone Bids at any time. The Auction Company will
ship select items by UPS, FED-X or US Post Office, for actual shipping costs.
The Auction Company will not be responsible for any goods damaged during
shipping. Purchasers are required to pay for proper insurance, which will be
added to the cost of shipping. This agreement is binding upon the parties, their
heirs, personal representatives, successors and assignees. We are very busy, so

Bids: All
live phone bidding will require a minimum opening bid of $ 500.00. The
Auction Company reserves the right to require higher opening bids on selected
items. Some phone charges may apply. All absentee bidding and other terms apply.
All Phone Bids Must Be In By 5:00 P.M. The Day Previous To The Auction. No
Exceptions!

+1 Bids:
A
"+1" placed next to your maximum bid permits the Auction Company to
increase your bid by one increment in the event that the high bidder bids on
your exact dollar amount. In the event that identical bids are received, the
first received will take precedence. Bidding on all items starts on the sales
floor. Absentee Bids are executed competitively against the Auction Crowd.
